1. Introduction
These Terms and Conditions (“Terms”) govern the use of the website www.jennesa.com (the “Site”) and the booking and provision of online language lessons and related services (the “Services”) offered by Jennesa Rakpathum (the “Provider”, “we”, “us”).
By accessing the Site or booking Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.

3. Services
The Provider offers online language lessons, including trial lessons, single lessons, and multi-lesson packages.
4. Digital Services
The Services consist exclusively of online language lessons conducted via video conferencing software (e.g. Zoom).
No physical presence is required.
The customer is responsible for ensuring a stable internet connection and suitable technical equipment.
5. Prices and Tax Information
All prices are stated in euros (EUR). Prices shown in Thai Baht (THB) are indicative only and provided for reference purposes. The final and binding payment amount is charged in EUR.
All prices are final prices. In accordance with §19 UStG (Kleinunternehmerregelung), no value added tax (VAT) is charged or shown.
The Provider reserves the right to change prices at any time; however, the price confirmed at the time of purchase is binding.
6. Payment
The following payment methods are accepted:
- Credit and debit cards via Stripe – default
- PayPal – on request
- German bank transfer – on request
- Thai bank transfer – on request
Full payment is required before any lesson or package can be booked or used.
7. Right of Withdrawal
7.1 EU Consumers
Consumers residing in the European Union have a statutory right of withdrawal of fourteen (14) days from the date of purchase, in accordance with applicable EU consumer protection laws.
7.2 Expiry of the Right of Withdrawal for Digital Services (EU Consumers)
The right of withdrawal expires once the service has begun, provided that:
the consumer has expressly agreed that the service shall begin before the expiry of the withdrawal period, and the consumer has acknowledged that they thereby lose their right of withdrawal. Booking or attending a lesson constitutes the start of the service.
7.3 Customers Residing Outside the European Union
Customers residing outside the European Union do not have a statutory right of withdrawal under EU consumer protection law.
For such customers, refunds are granted only in accordance with the Refund Policy set out in Section 8 of these Terms and Conditions.
8. Refund Policy
Refund requests must be submitted within fourteen (14) days from the date of purchase.
Refunds apply only to unused lessons.
The following are non-refundable:
- completed or partially completed lessons;
- lessons missed due to no-show;
- trial lessons;
- single-lesson bookings.
Lesson packages are non-transferable.
Unused lessons remaining after the package validity period expire without refund.

9. Booking, Cancellation, and Rescheduling
- Lessons must be booked at least 24 hours in advance.
- Cancellations or rescheduling must be made at least 24 hours before the scheduled lesson.
- Changes made less than 24 hours before the lesson result in the lesson being deducted from the package.
- If a student is up to 10 minutes late, the lesson duration will be shortened accordingly.
- If a student is more than 10 minutes late or does not attend without notice, the lesson is considered a no-show and is non-refundable.
- If a lesson is cancelled by the Provider, a make-up lesson will be arranged.
10. Lesson Packages
- Lesson packages are valid only for the validity period specified at the time of purchase.
- Any unused lessons expire after the validity period.
- Lesson packages are personal to the purchaser and cannot be transferred to another person.
- Lessons must be booked using the same email address used for purchase.
11. Force Majeure
The Provider shall not be liable for failure or delay in performance due to events beyond reasonable control, including but not limited to technical failures, internet outages, platform downtime, illness, or other force majeure events.
In such cases, lessons will be rescheduled where reasonably possible.
12. Intellectual Property
All content on the Site and within the Services (including text, images, videos, audio, and teaching materials) is the intellectual property of the Provider or its licensors and is protected by copyright law.
Content may be used only for personal, non-commercial purposes.
13. User Conduct and Restrictions
Users must not:
reproduce or distribute Site content without permission;
use the Site unlawfully or abusively;
interfere with Site functionality;
use the Site for unauthorized marketing or data extraction.
14. User Content
If users submit content to the Site, they grant the Provider a non-exclusive right to use such content for service delivery. Submitted content must not infringe third-party rights.
15. Disclaimer of Warranties
The Site and Services are provided “as is”. While the Provider strives for accuracy and availability, uninterrupted or error-free operation cannot be guaranteed.
16. Limitation of Liability
The Provider is liable only for intent and gross negligence. Liability for personal injury, mandatory statutory liability, or liability under applicable consumer protection laws remains unaffected.
17. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
If the customer is a consumer residing in the European Union, mandatory consumer protection provisions of the consumer’s country of residence remain unaffected.
For consumers, jurisdiction is determined in accordance with applicable statutory consumer protection laws.
For customers who are not consumers and for consumers residing outside the European Union, the exclusive place of jurisdiction shall be the registered place of business of the Provider in Germany.
18. Changes to These Terms
The Provider reserves the right to amend these Terms at any time.
The version in effect at the time of booking shall apply.
19. Language Version
These Terms and Conditions are provided in English for international customers.
In case of discrepancies or differing interpretations, the English version shall prevail.
